American conglomerate 3M, known for the manufacture of security and other equipment for various industries, is facing a multi-district litigation (MDL) in Florida over the sale of defective double-sided combat weapon earplugs to soldiers. This MDL has grown to be the largest in American history and shows no signs of slowing down as the latest general inspection found that battle earplugs sold by 3M caused hearing loss and tinnitus, which recently set a record 8.2 million U.S. dollars to a former U.S. soldier. The beginning

In 2008, 3M acquired Aero Technologies, a company that won a government contract in 2003 to develop double-ended earbuds that could provide soldiers with either total or partial protection from loud noises. After 3M developed the earbud, initial tests showed that the end of the earbud, which was intended for full protection, achieved a Noise Reduction Rating (NRR), which suggests that this end of the earbud is not blocking all noise as intended. Because of the alleged design flaws in the earplugs, 3M allegedly knew the NRR was inaccurate and exaggerated noise control and marketed the earplugs to the military for more than a decade without disclosing the design flaw in the earplugs.

A little over a year later, since the 3M lawsuits piled up, the lawsuit has now become the largest mass crime in American history, surpassing the decade-long asbestos mass offenses that ranked first. After a judge from north Florida created an MDL to try to resolve the nearly 260,000 cases before 3M, a judge in north Florida planned various lead trials so that both sides could test their arguments and determine the range of damages and possible comparisons. To date, 3M has been sentenced to a total of $ 17 million in 4 main lawsuits and has lost most of the cases so far.

In the fourth main study, 3M was blamed for tinnitus and hearing loss in U.S. Army Veteran Brandon Adkin. As a result, a federal jury ordered 3M to pay Adkins $ 8.2 million for the damage caused by the faulty earbuds he wore while on duty. With this lead trial being the most expensive for 3M to date, with six more trials planned, 3M could potentially be inclined to reach a global agreement sooner than expected.

As of August this year, 3M’s defense was struggling to gain a foothold in the courtroom after a U.S. district judge found 3M could not rely on the statute of limitations to expel a previous plaintiff because 3M allegedly kept the earplug deficiencies a secret would have.
